Your Agreement. Pink Label is brought to you by Surecom Corporation NV, (“Surecom”), operating as 'Pink Label.com' and and under the trade and service mark 'Pink Label', and in conjunction with Granity Entertainment, DAC, a Dublin, Ireland company and TLE Opportunities, LLC, a Delaware company, which are third-party service providers authorized by Surecom to provide payment processing of transactions. References to "Pink Label" is synonymous with Surecom Corporation, NV.
By accessing Pink Label you agreed to be bound by these Terms of Use and our Privacy Policy found at http://pinklabel.com/privacy/ When you entered, you were asked if you agree to the Terms of Use and you indicated that you do by clicking "YES" or "ENTER". We collected your IP address and time that you made this decision to be bound by our Terms of Use.
Pink Label reserves the right, in its sole discretion, to modify these Terms of Use at any time by posting revised Terms of Use through the Site. You are responsible for reviewing and becoming familiar with any modifications to this Agreement. Modifications are effective when posted, and your use of the services following any such posted modification and notice of same constitutes your acceptance of the Terms of Use as modified.
Failure to comply with the most recent version of the Terms of Use may result in immediate account termination.
Eligibility. You must be 18 years of age or older to access and use the Pink Label affiliate program and, of course, use of Pink Label services is void anywhere where such use is prohibited by law.
Upon joining Pink Label you must provide accurate and valid details regarding your identity and your payment details. If you provide false information you will face immediate termination of your account and you may be subject to legal sanctions.
You agree that Pink Label may email you from time to time regarding new features, payouts, promotions, and information about Pink Label.
Pink Label, in its sole discretion, may deny a prospective affiliate admittance into our program based on Pink Label’s understanding of the affiliate’s traffic sources or the content of the affiliate's site, or any other reason.
Any attempt to defraud the Pink Label affiliate program will result in the termination of the affiliate's account and the forfeiture of any and all monies due.
All content on affiliates sites must be fully compliant with United States Code, Title 18, Section 2257 et seq. or any other applicable statutes, or laws of any other jurisdiction concerning depictions of sexually explicit conduct, real or simulated.
Prohibited Content. Affiliate’s sites must not contain any illegal and/or objectionable
material. A partial list of prohibited content includes
- child pornography
- rape
- incest
- bestiality
- any attempt to solicit personal information from anyone under 18
- obscene material
- content that threatens suicide or harm to oneself or others
- harassing or bullying material
- any attempt to invade the privacy of another person
- anything that promotes the illegal or unauthorized copying of another’s copyrighted work (such as pirated computer programs or links to them, or providing information to circumvent manufacturer-installed copy-protect devices, or providing pirated music or links to pirated music files)
- any transmission of “junk” mail, “chain letters” or unsolicited commercial email or "spam"
- the promotion of information you know is false, misleading or promotes illegal activity or conduct that is abusive, threatening, defamatory or libelous
- content that contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page)
- any advertisements in chat or instant messaging messages
- any file or data stream that contains viruses, worms, "Trojan horses" or any other destructive features
- any promotion or solicitation of business for another site
Pink Label does not pay for traffic from email spam sources and you are strictly prohibited from sending (or causing to be sent) any email having to do with Surecom or its affiliated sites which in any way violates federal, state or local laws regarding unlawful or prohibited emails. If you deal in spam email, your affiliate account will be terminated and you will forfeiture any monies due you at the time of termination.
Precluded Traffic Sources. Affiliates modifying surfers' browser settings without the surfers' express consent will be presumed to be sending unsolicited advertising and will be treated in the same way as email spam and may result in the termination of the affiliate's account and the forfeiture of any and all monies due, as well as indemnity for losses sustained by Pink Label.
If an affiliate performs a self-sign-up, it must be done with the consent of Pink Label by contacting support@pinklabel.com. Without prior consent, Pink Label may refuse payment for the join or terminate your affiliate account.
Affiliates may not require third parties to join Pink Label sites as a requirement to accessing other products or services.
Affiliates are not allowed to offer third parties any incentive or bonus for viewing or joining Pink Label sites using their Pink Label affiliate linking code.
Affiliate Payments. Pink Label offers several payout programs. Payout details are disclosed upon entering Pink Label.
Affiliate understands and agrees that he/she will earn the payout from revenue generated by members’ joins and/or signups sent through the affiliate's Pink Label link, less any refunds and chargebacks which occur.
When Pink Label pays per spending member, affiliate will be paid only for new unique spending members in the Pink Label database that were successfully billed, and did not later require chargebacks or refunds.
Lifetime Revenue Share payouts may change from time to time without prior notice. Changes will take effect only from the time of change forward.
We may change any payout program selected by affiliate to the standalone Lifetime Revenue Share program, and/or terminate the affiliate's account if the join conversions do not justify the payout program that has been chosen by the affiliate.
Pink Label payouts are determined solely by the reports and statistics shown on the site.
If the Affiliate’s conversion rates are lower than required by Pink Label, or if the affiliate’s traffic volume is low, in Pink Label’s sole determination, Pink Label will terminate the affiliate’s account. All monies due and owing at that time will be paid.
Pink Label reserves the exclusive right to change affiliate’s payout program or rate without notice.
Pink Label’s payments may be delayed in the event our processors’ payments to us are delayed. Typically, Pink Label will process checks, domestic US wires, and TLE Opportunity payouts on a weekly basis. The Pink Label system updates on Sundays at 12AM Pacific Time and payments are processed over the next two days.
Pink Label reserves the right to cancel this program at any time, without prior notification. In the event Pink Label cancels the program, Pink Label will notify you immediately and pay all monies owed and payable at that time (within a reasonable time).
Hold Harmless. Pink Label is not responsible for any loss (economic or otherwise) due to downtime resulting from complications with hosting equipment or technical errors, and affiliate agrees to hold Pink Label harmless for any such losses.
Indemnity for Illegal Email. In the event any third party brings a claim or legal action against Surecom or any of its affiliated entities because of email you sent or in any way caused to be sent, then you agree to indemnify, hold harmless, and defend Surecom and any of its related entities against any such claim or other legal action and you will pay legal fees. Do not tamper with Pink Label’s links and promotion tools as that will result in non-payment of monies due and termination of your affiliate account.
Affiliate Representations and Warranties. Affiliate represents and warrants that:
- it will refrain from any and all illegal activities in promotion of Pink Label’s sites
- It will adhere to acceptable usage policies for any sites used to promote the program
- funds earned and paid to it by Pink Label will never be used to engage in the support of:
- money laundering activities
- any illegal activity as defined by applicable law
- any group or activity related to terrorism
- armed conflict between nation states or any group or organization
Abuses and Violations. Abuse reports received are logged and investigated by the Pink Label team, and if found to be valid, affiliate’s accounts may be suspended or terminated without prior notice and payments withheld.
Affiliate agrees that Pink Label has the exclusive right to determine if any violation(s) have occurred.
Miscellaneous. These Terms of Use shall be governed by and construed in accordance with the laws of the Country of Curaçao, excluding its conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms and Conditions or your use of Pink Label shall lie only in the courts of Curaçao , and you further agree to and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.
These Terms of Use constitute the entire agreement between the affiliate and Pink Label and they supersede all other prior written or oral agreements and/or representations. Any violation of the aforementioned terms and conditions will result in termination of the affiliate’s account and forfeiture of any available funds.
